Emmanuel N. Onochie

Emmanuel Onochie represents clients in intellectual property disputes involving complex technologies. His practice focuses on patent and trade secret litigation, as well as counseling clients on artificial intelligence and related intellectual property issues. His patent litigation experience includes matters involving the Hatch-Waxman Act, the Biologics Price Competition and Innovation Act (BPCIA), pharmaceuticals and biologics, and software technologies.

Emmanuel has experience across all phases of patent and trade secret litigation, including trial, discovery, expert proceedings, motion practice, and infringement and invalidity contentions. He also advises clients on artificial intelligence, including AI inventorship and the patentability of AI-assisted innovations. Emmanuel completed MIT’s Executive Program on Artificial Intelligence in Pharma and Biotech and has published and presented on the intersection of AI and patent law. Emmanuel has also worked on a wide range of technologies, including AI, automobile software technology, large and small molecule drug compounds, and general consumer products. He has also represented clients in the District of New Jersey, the Southern District of Texas, the Northern District of Illinois, and the Central District of California.

Before entering private practice, Emmanuel served as a legal extern to Chief Justice Patience D. Roggensack of the Wisconsin Supreme Court and interned with a Fortune 100 global biopharmaceutical company, where he assisted with patent prosecution and licensing matters. He has also served as an adjunct professor at Howard University School of Law, teaching patent law and public policy, and has been recognized on the Capital Pro Bono High Honor Roll.

• Represented AbbVie Inc. in Biologics Price Competition and Innovation Act (BPCIA) patent litigation involving Humira®. Serving as an associate on the case, Emmanuel was involved in all aspects of the litigation prior to its favorable settlement. AbbVie Inc. v. Alvotech hf., No. 1:21-cv-02258 (N.D. Ill.). • Represented Swedish Match North America LLC and related entities in trade secret litigation involving DRYFT® nicotine pouch products. Serving as an associate on the case, Emmanuel was involved in all aspects of the litigation prior to its favorable settlement. Pinkerton Tobacco Co., LP, et al. v. Kretek International, Inc., et al., No. 2:20-cv-08729 (C.D. Cal.); Swedish Match North America LLC, et al. v. Modoral Brands Inc., No. 2:21-cv-05013 (C.D. Cal.). (Prior to joining Robins Kaplan LLP)
• Represented Bausch Health Ireland Limited in Hatch-Waxman patent litigation involving Trulance®. Serving as an associate on the case, Emmanuel managed the litigation and was involved in all aspects of the litigation prior to its settlement. Bausch Health Ireland Limited, et al. v. • Represented BMW of North America, LLC in a patent infringement case against Ad Innovations, where Emmanuel served as the lead associate to obtain a swift victory by showing the accused feature was not present in the U.S. Ad Innovations v.
