Overview

Scott L. Bittman is an intellectual property litigator and counselor who represents clients in high-stakes patent, trade secret, trademark, and other technology-focused disputes. He has litigated before federal and state courts throughout the country, the Patent Trial and Appeal Board (PTAB), the International Trade Commission (ITC), and the U.S. Court of Appeals for the Federal Circuit.

Scott has litigated matters across a wide range of technologies, including helicopter avionics displays, hybrid vehicle controls, wheelchair suspension systems, train control systems, email authentication technology, power tool batteries, power-over-Ethernet systems, machine vision software, web-based telecommunications, and advanced materials manufacturing technologies.

Bringing a practical and strategic approach, Scott handles all phases of litigation, from early case assessment and claim development through trial and appeal. His experience includes jury trials and ITC hearings involving significant damages claims and high-value intellectual property assets. He likewise has an extensive patent post-issuance review practice, which has included representing clients in all aspects of numerous inter partes review and post grant review challenges.

In addition to litigation, Scott counsels clients on intellectual property enforcement, licensing, risk management, and procurement strategies. He advises clients on freedom-to-operate analyses and prepares opinions relating to patent invalidity, noninfringement, and unenforceability. He also assists with intellectual property diligence in connection with corporate transactions.

Prior to law school, Scott worked as a design engineer for a global manufacturer of electronic monitoring, testing, and display instruments. His engineering background gives him a practical technical perspective in matters involving sophisticated mechanical and electrical technologies.

Scott also maintains an active pro bono practice and has been recognized as an “Empire State Counsel” by the New York State Bar Association for his pro bono service.

  • Represented a transportation technology company in a wide-ranging, multi-forum intellectual property dispute involving positive train control technology, including a jury trial win resulting in a finding of willful infringement and a $15 million damages award, as well as the defense of 15 inter partes review proceedings.
