Partners David Prange and Benjamen Linden will present at the Licensing Executives Society (LES) 2025 Annual Meeting in Boston on Sunday, October 19. Their session, “Protecting Your Investment: Litigating or Arbitrating, and Structuring Forum Selection, Choice of Law, and All Those Other Terms That Are Easily Overlooked at the Start” will explore the pros and cons of dispute resolution forums (litigation v. arbitration), the role and timing of mediation, and the strategic structuring of arbitration provisions, and other terms that can be used to improve the chance of dispute resolution success or deter disputes altogether.

This session will examine various jurisdictions for insight on addressing various situational complexities related to forum selection, rule selection, continuing relationships and multiple contracts, and other potential exit strategies. Attendees will gain a better understanding of the different dispute resolution forums and their impact on the resolution process, the contractual terms that should be considered and evaluated if presented, examples of what not to do, and key points for advising business leaders on their options when a dispute arises.
