Defended Mailchimp and Obtained Dismissal of Patent Litigation Involving Email Content Creation Technology

Pivital IP LLC v. The Rocket Science Group LLC, Case No. 20-CV-01616 (SDNY)
Robins Kaplan represented Georgia company The Rocket Science Group LLC d/b/a Mailchimp in a patent litigation matter brought by Pivital IP LLC. According to the complaint, Pivital accused Mailchimp of infringing Pivital’s patent on technology used to create dynamic email content.
Pivital alleged this technology allegedly allows the sender to deliver content that is customized to predesignated subsets of the recipient list all within the same email, allegedly making email messaging more efficient and lowering bandwidth requirements.
Robins Kaplan successfully obtained dismissal of the complaint against Mailchimp after demonstrating that the subject matter covered under Pivital’s patent was unpatentable.
