Obtained Settlement for Celgard in Patent Litigation against MTI, a Competitor in the Battery Separator Market

June 2019

Celgard, LLC v. MTI Corporation, Case No. 5:18-cv-07441-VKD (N.D. Cal.)

Robins Kaplan represented Celgard, LLC in a patent litigation matter against MTI Corporation. Celgard is a global leader in the development and production of specialty microporous membranes, including separators used in lithium-ion batteries for consumer electronic devices and electric vehicles. MTI competes with Celgard in the battery separator market.

According to the complaint, MTI infringed upon Celgard’s United States Patent No. 6,432,586 (“the ’586 patent”), entitled “Separator for a High Energy Rechargeable Lithium Battery,” with its ceramic-coated separator products. The complaint further alleged that MTI falsely represented certain of its own products as “made by Celgard.”

The complaint, filed in the Northern District of California, sought compensation for MTI’s past and present infringement. The matter settled on confidential terms.
