Robins Kaplan Secures $20 Million Jury Verdict in Wrongful-Death Medical Malpractice Case

Chris Messerly and Elizabeth Fors secured a judgment exceeding $20 million on behalf of client Edward Bermingham and his four-year-old son for the death of Edward’s wife, Nicole Bermingham, who passed away days after giving birth to the couple’s first child. 

Nicole Bermingham was discharged after giving birth and returned to the emergency room three days later with a fever and nausea, and was sent home by defendant Patricia Eid, the nurse practitioner who treated her. She returned twelve hours later with the same symptoms and died despite the valiant attempts that were made to save her life.

Robins Kaplan’s attorneys argued that the defendants, Patricia Eid and Minneapolis-based Emergency Care Consultants, were at fault due to the fact that Eid ignored lab test results showing that Bermingham had sepsis and sent her home.

“We’re very pleased with the outcome of this case for our client and his family,” said Elizabeth Fors, one of the lead attorneys on the case. “But this is something that was completely preventable and never should have happened in the first place.”

The case Edward Bermingham IV v. Patricia Eid NP et al., case number 27-CV-16-1269, was tried in the Hennepin County District Court, Fourth Judicial District of Minnesota.
