Overview
Ellen Levish is a trial-focused intellectual property litigator who represents clients in high-stakes disputes nationwide. As an associate in Robins Kaplan’s Intellectual Property and Technology group, she handles complex patent, trademark, copyright, and trade secret matters, including Hatch-Waxman (ANDA) pharmaceutical litigation and disputes involving computing and software technologies.
Ellen brings real courtroom experience to her cases. She has second-chaired bench trials under the Lanham Act, conducted direct and cross examinations of fact witnesses and damages experts, argued pretrial and mid-trial motions, and supported lead counsel in opening and closing statements. She was part of a trial team that secured a complete defense verdict after a seven-day bench trial. She helped obtain favorable summary judgment rulings in matters presenting novel copyright and DMCA issues.
Her pharmaceutical practice involves representing both branded and generic companies in ANDA litigation—where patent law, FDA regulation, and cutting-edge science intersect. She also litigates computing and technology-driven disputes, translating sophisticated technical concepts into precise, persuasive advocacy for judges and juries. Drawing on her background in neuroscience, Ellen brings a disciplined, scientific perspective to patent litigation across industries.
