Insurance Litigation

Taylore’s insurance practice often involves coverage issues at the forefront of emerging trends in the industry. Most recently, this has included several COVID-19 claims, where she has been successful in defending clients in policy coverage disputes. She has also successfully represented insurers in appraisal and arbitration proceedings.

Her experience spans across a broad range of coverage forms, including:

  • Commercial Property
  • Commercial general liability
  • Excess and surplus lines
  • Builders risk
  • Time element
  • Personal lines
  • Reinsurance

In addition to her litigation work, clients turn to Taylore for trusted coverage advice. Leaning on a nearly a decade of experience in the insurance practice, she counsels clients on policy issues such as evaluation of exposure, identification and assessment of coverage defenses, and provides advice on claims handling practices and litigation.

Business Litigation and Counsel

Taylore also counsels and represents non-insurer clients in general business litigation matters, at all phases of a dispute. Her case history includes representation of companies in the financial services, healthcare, product testing, and construction industry, as well as individuals in matters involving contracts, unfair and deceptive business practices, negligence, implied warranties, and statutory claims.

Pro Bono and DEI

Taylore maintains an active pro bono case load. While at Robins Kaplan, she assisted a community organization in a non-litigated contract and G.L. c. 93A dispute. She has also helped to secure asylum for an immigration client and continues to represent her client in other immigration related matters.

She also serves as Co-Chair of the firm’s Women of Robins Kaplan Resource Group (WoRK) group and is a leader in the Women in Insurance Group. Both of these organizations seek to advance women in the practice of law and provide opportunities for women to grow through mentorship.

Represented Liberty Mutual Fire Insurance Company in a COVID-19 matter filed in the United States District Court for the District of Oregon. The plaintiffs asserted coverage claims for their financial losses resulting from government ordered shutdowns. Our team successfully defended the client, winning a motion to dismiss the complaint with prejudice. Subsequently, the 9th Circuit Court of Appeals dismissed the appeal.

Represented Liberty Mutual in a coverage dispute involving a sewage backup that damaged an insured’s home. The case concerned a water damage exclusion that used the phrase “escape or overflow” in lieu of the more common “backup.” Such an exclusion had not yet been interpreted by any court in the nation. The matter was resolved when the U.S. District Court, District of Maine, granted summary judgment in favor of our client.

Over four Massachusetts bench trial verdicts received on behalf of insurers in actions involving residential property coverage disputes and/or allegations of unfair and deceptive insurance practices. (Prior to joining Robins Kaplan LLP)

Obtained summary judgment on behalf of insurer in Massachusetts declaratory judgment action seeking a declaration that the insurer had no duty to defend or indemnify its insured or any other party for property damage sustained to a Massachusetts hospital during a large-scale construction project. The court held that the insurer had no duty to defend or indemnify because coverage was excluded under the unambiguous terms of the business risk exclusions contained in the commercial general liability policy of insurance. Obtained dismissal of G.L. c. 93A/176D claim (bad faith) against insurer in Massachusetts suit involving a dispute over the availability of coverage under an income benefits policy of insurance. (Prior to joining Robins Kaplan LLP)
