Obtained Freedom to Operate for Sherwin-Williams through Successful Defense of Patent Infringement Case Involving Antimicrobial Chemicals

Arch Chemicals, Inc. v. Sherwin-Williams Company

Robins Kaplan LLP represented The Sherwin-Williams Company and its predecessor The Valspar Corporation in a patent infringement case involving alleged infringement of patents covering antimicrobial biocide compositions. 

The case resolved with the grant of a covenant not to sue issued to The Sherwin-Williams Company following submission of Petitions for inter partes review before the USPTO Patent Trial and Appeal Board (PTAB).

This case was a significant win for our client and provided the freedom to operate across a broad range of accused products.
