The Deposition of Witnesses Who Were Previously Deposed on Different OxyContin Patents

Purdue Pharma L.P. et al. v. Mylan Pharmaceuticals Inc. et al.

Case Number: 1:12-cv-02959-SHS (Dkt. 36)

The court refused to bar defendant from deposing witnesses who had been previously deposed in other OxyContin cases:  “The mere fact of a witness’s prior deposition in a separate, albeit formally related, action does not foreclose a further deposition.  Defendants may take these depositions, although the court notes that the parties avoid seeking duplicative discovery.”
