Judge Stein approved the settlement between plaintiffs Purdue et al. and defendant Sandoz Inc. with respect to the U.S. Patent No. 8,114,383 (entitled “Abuse-proofed dosage form”). This patent relates to the drug oxycodone, sold by Purdue as OxyContin. Sandoz agreed that the patent was valid and enforceable against its products, that its ANDA products infringed the claims asserted against it, and agreed not to make, have made, use offer to sell, sell, or import generic oxycodone products until an undisclosed terminal date. Plaintiffs agreed not to sue Sandoz for products authorized by a separate, confidential agreement.
