Obtained settlement for grocery company in trade secret case brought against former executive and competitor

February 20, 2013

SuperValu Inc. v. Bergmann; Unified Grocers, Inc. v. SuperValu Inc.

Represented Supervalu in companion cases arising out of the departure of a key executive to a competitor, in violation of noncompetition and confidentiality agreements. The former executive and competitor brought a declaratory judgment action in California to invalidate the noncompetition agreement, and Supervalu filed an action in Minnesota against the former employer and competitor for breach and interference with those agreements. After argument on Supervalu’s motion for a temporary restraining order, the case settled confidentially on terms favorable to our client.
