Represent Coventry Health Care, Inc., in a purported nationwide class action alleging substantially the same claims as those asserted in Hoda v. Coventry Health Care, Inc., but filed in a different federal District Court. The Court granted Coventry's motion to dismiss the plaintiff's claim for injunctive relief on the ground that the plaintiff did not have standing to assert the claim. After discovery, the Court denied the plaintiff's motion for class certification on its claim for damages. The Court then granted the plaintiff's motion for leave to amend its complaint to add a plaintiff that had standing to assert a claim for injunctive relief. After additional discovery, the plaintiffs moved for class certification of the added plaintiff's claim for injunctive relief and for summary judgment. Motion for summary judgment was denied.
